1. Scope
These General Terms and Conditions of Sale (hereinafter the "GTC") apply, without restriction or reservation, to all sales concluded via the e-commerce website https://shop.airmkg.eu (hereinafter "the Site") between Air MKG, a limited liability company with a share capital of 10,000 euros, registered in the Annecy Trade and Companies Register under number 491 528 733, whose registered office is located at 1096 avenue André Lasquin 74700 Sallanches – France (hereinafter "Air MKG") and the end consumer wishing to acquire the products marketed on the website (hereinafter the "Products") for their personal or professional needs, it being agreed that in the context of a professional activity, the latter must be unrelated directly or indirectly to an activity as an intermediary or reseller (hereinafter the "Customer").
Air MKG and the Customer are jointly referred to as the "Parties."
The Customer declares that they have the legal capacity to enter into a contract within the meaning of Articles 1145 et seq. of the Civil Code and certifies that they are an adult natural person acting for their personal needs or their professional needs, as defined above. The Customer confirms their commitment not to resell the Products for commercial purposes.
2. Acceptance of the General Terms and Conditions of Sale
Placing an order on the Site implies full and unreserved acceptance of these GTC, which are accessible at any time on the Site. Air MKG invites you to print and keep a copy of these GTC for future reference.
The GTC applicable to the order are those in force on the date the order is placed. Air MKG reserves the right to modify these GTC at any time. These modifications are published by being put online and are deemed accepted without reservation when the Customer accesses the site after they are put online. In the event that one of the clauses of these GTC is null and void due to a change in legislation, regulations or a court decision, this shall in no way affect the validity and respect of these GTC nor call into question the validity of the other provisions which will continue to apply.
3. Products
3.1. Characteristics and Information Relating to the Products
Prior to ordering, the Customer may consult the essential characteristics of the Products they wish to order on the Site, as presented in each of the Product sheets. The choice of purchase and the choice of a Product are the sole responsibility of the Customer.
The Customer is required to refer to the description of each Product in order to know its essential properties and characteristics. The information on the Site is as accurate as possible. However, photographs and other reproductions of the items are for illustrative purposes only and have no contractual value.
3.2. Availability of Products
Our offers of Products and prices are valid as long as they are visible on the Site, except for special offers whose period of validity is specified on the Site. Air MKG invites the Customer to consult the availability of the Products sold on the information page of each Product.
Errors or modifications may exceptionally exist, in particular in the case of simultaneous orders of the same Product by several customers.
In the event of an order for a single product that proves to be unavailable, Air MKG reserves the right to cancel the order, subject to notifying the Customer.
In the event of an order for several Products, if one of the Products ultimately proves to be unavailable, Air MKG will then inform the Customer of the impossibility of sending the unavailable Product. The rest of the order will be processed and shipped to the Customer within the deadlines announced by the information email on their order tracking. The Customer may also opt for the total cancellation of their order, subject to informing Air MKG in advance by telephone or email.
In order to ensure a better quality of service and availability of Products to all Customers of the Site, Air MKG reserves the right to limit the quantity of Products that can be purchased by the Customer, in accordance with the applicable provisions in this area and in particular those of Article L. 121-11 of the Consumer Code.
4. Order
In order to be able to place an order for Products, the Customer must follow the following steps:
• Add one or more Product(s) available on the Site to your basket;
• Log in to their Customer account or create a Customer account on the Site;
• Choose a delivery method;
• Specify their delivery address or verify their details if they have an account on the Site. In this regard, the Customer, when creating the account, must create their username and password. The Customer must take care to protect their password and not disclose it. Indeed, it is important to note that the Customer is responsible for any purchase made with their username and password, even if this is not your doing;
• Choose a payment method;
• Accept the GTC;
• Verify the elements of their order and, if necessary, return to the previous steps to correct any errors;
• If they have chosen payment by credit card:
Enter their bank details;
Pay for their order by clicking on the "Pay" button. In this regard, the Customer must hold a valid credit card.
The order will be deemed finalised at the time of validation of payment issued by the Customer's payment organisation.
• If they have chosen payment by bank transfer or cheque: validate their order by clicking on the "Place Order" button.
In this case, the order will be deemed finalised upon receipt of funds into Air MKG's bank account. For information purposes, transfers take an average of 4 to 5 working days to be validated on our account. Cheques may require a longer period to be checked by our bank. Air MKG undertakes, however, to process the order upon receipt of the Customer's bank cheque, if the latter has proceeded to pay for their order by bank cheque. The Products remain the property of Air MKG until full payment of the price.
In the event of prolonged inactivity during the connection, it is possible that the selection of Products chosen before this inactivity is no longer guaranteed. The Customer will be invited to resume their selection of items from the start.
The Customer will then receive by email:
• an acknowledgement of receipt confirming the order;
• a confirmation of payment of the order;
Air MKG reserves the right not to accept an order in the event of non-compliance with the GTC in the event of errors, anomalies in the order, in the event of a payment incident or suspicion of fraud and/or abuse.
• confirmation of the shipment of the order.
5. Price – Payment – Delivery Costs
5.1. Price
Unless otherwise stated, the prices displayed on the Site are expressed in euros (€).
Air MKG reserves the right to change prices at any time; Products will in any case be invoiced on the basis of the rates in force at the time the order is placed.
In accordance with applicable rules and regulations, any purchase made through the Site is subject to value added tax (VAT), which will be indicated when the order is validated.
Regarding sales made for professional needs, the Air MKG operating system does not allow sales exempt from VAT for companies registered in the territory of the European Community and holding an intra-community VAT number.
Air MKG invites you to follow the following procedure:
- Place the order on the Site following the process described in Article 4 hereof;
- Indicate your VAT number in the observations, as well as your billing address;
- If your delivery address is located outside the Schengen area, you will pay the amount of your order excluding VAT;
- Pay the amount of your order with VAT. When validating your order, after checking and validating your VAT number, Air MKG will deduct the corresponding French VAT and you will only be debited the amount excluding VAT;
- Air MKG will issue you an invoice excluding VAT with your VAT number corresponding to your company name. Air MKG must issue its invoice in the name and address that you have filled in the billing box; it must correspond to the name of the professional document provided.
If one or more taxes or contributions were to be modified, as well as in the event of the creation of new taxes or contributions, this change may be reflected in the sale price of the Products. No tax or contribution not provided for at the time of the order may be subsequently requested from the Customer.
The prices invoiced are those in force on the date of the order. The Customer is informed that prices are subject to change. The Customer is therefore invited to pay attention to the price in force at the time of the order and which is mentioned on the Site when his product is placed in the shopping cart.
The amount of transport costs relating to the delivery of the Products will automatically appear on the Site when validating the shipping method (DHL standard or express) chosen by the Customer and will be communicated again to the Customer when confirming his order by e-mail. The payment requested from the Customer corresponds to the total amount of the purchase, including delivery costs.
Confirmation of the price paid and the delivery costs charged to him in the form of an invoice in euro (€) currency is available to the Customer on his personal account accessible from the Site.
Sale dates vary from country to country. The Customer can contact Air MKG Customer Service by e-mail to obtain more information regarding sale dates in a particular country.
5.2. Payment
The price is payable in cash, in full on the day the order is placed by the Customer, by secure payment, according to the following methods:
• by credit card, cards from the following network are accepted: Visa, MasterCard, Carte bleue, E-carte bleue
To this end, the Customer guarantees to Air MKG that he is the holder of the credit card he uses and that the name appearing on this credit card to be debited is his own, then communicates in a secure environment via the Internet, the number and expiration date appearing on the front of his credit card as well as the numbers of the visual cryptogram appearing on the back (or front) of his credit card. The Customer will be debited when his order is validated.
• by Paypal
• For countries other than mainland France, DROM-COM, Sp armée, Belgium, Luxembourg, Switzerland and Quebec (whose terms are described above), only payments by credit card validated on our account will be accepted.
The amount due is the amount indicated on the order confirmation page displayed to the Customer at the time of payment (unless otherwise detailed in Article 6.4 hereof).
In the event that, for any reason whatsoever (opposition, refusal of the issuing centre, etc.), the debit of the sums due by the Customer proves impossible, the sale made would be immediately cancelled and the online purchase process cancelled. Air MKG's liability cannot under any circumstances be engaged in this respect.
Air MKG also reserves the right to refuse the Customer any order or to honour a delivery if a previous payment dispute exists.
5.3. Transaction security
The Customer's credit card details are encrypted using the SSL (Secure Socket Layer) protocol and never pass unencrypted over the Internet. Payment is made directly to our bank, which means that no Customer's bank information passes through the Site.
Despite the encryption of data, Air MKG recalls that no data transmission over the Internet is 100% secure and that the information communicated online may be potentially intercepted and used by people other than the intended recipient.
6. Delivery
6.1. Delivery locations
The Products purchased on the Site are delivered to the delivery address that the Customer has provided when ordering. Air MKG has the possibility to deliver to all countries of the world, once the delivery method and its associated costs have been validated by the Customer.
The Customer is informed that Air MKG cannot be held responsible in the event of erroneous information when the Customer enters his delivery address.
The Customer undertakes to communicate all information relating to the delivery conditions (place, recipient, etc.) when ordering. This information is binding on the Customer. In the event of an error in the wording of the recipient's contact details or other information, Air MKG cannot be held responsible for any impossibility of delivering the Products ordered.
6.2. Delivery methods
The Customer can choose, when validating his order, between five (5) delivery methods:
• Collection at the Air MKG store in Sallanches,
• Chronopost.
For countries other than mainland France, the DROM-COM, Sp armée, Belgium, Luxembourg and Switzerland, Air MKG reserves the right to offer the Customer additional or alternative delivery method(s).
6.3. Delivery time
Deliveries are made by carrier within the time indicated on the Site, after the preparation of your package and from its shipping date. The Customer is informed of the shipment of his order by email.
For information purposes, the average shipping time varies from two (2) to five (5) working days after receipt of your paid order, with a maximum not exceeding three (3) weeks.
In addition, we inform you that in the event of a stock shortage on a Product, the delivery time may be longer than 3 weeks. In this case, you will be notified by email or telephone. The status of a Product whose restocking time is longer than three (3) weeks will be defined on the Site as "currently being restocked". We invite you to contact us to find out the expected restocking time.
In case of urgency, you can indicate this in the comments and we will do our best to deliver to you as quickly as possible.
Unless otherwise agreed by us, in the event of a missing Product, we will only ship the Order when all Products are available.
Air MKG invites the Customer to regularly check their order tracking on their customer account.
In accordance with the provisions of Article L. 216-2 of the Consumer Code, if delivery is not made within the indicated deadlines, the Customer may terminate the contract, by registered letter with acknowledgement of receipt or by a written document on another durable medium, if, after having instructed, according to the same methods, Air MKG to make the delivery within a reasonable additional period, the latter has not done so within this period. The sums that have been debited from them will be refunded.
If Air MKG is prevented from meeting the deadlines by a case of force majeure or a fortuitous event (article 13) by a cause beyond its control, in particular a fault that is attributable to the Customer, the delivery time is automatically extended according to the duration of the impediment. Air MKG will inform the Customer by e-mail of the occurrence and end of such impediments. If the impediment lasts more than one month, the Customer may terminate the order automatically, without the Customer being able to claim compensation.
6.4. Delivery cost
The cost of delivery (shipping costs) depends on the delivery option chosen, the country of destination and the weight of the Products.
• For any order of Product(s) less than 2kgs and delivered in mainland France, in the French overseas departments and territories (DROM-COM), in Sp army, in Belgium, in Luxembourg or in Switzerland: the delivery cost will be indicated to you before the validation of your order;
• For any order of Product(s) greater than 2kgs and/or delivered in a country other than mainland France, the French overseas departments and territories (DROM-COM), the Sp army, Belgium, Luxembourg, Switzerland, the United Kingdom, Austria, Spain, Italy, Poland, Portugal, Sweden, Denmark, Ireland, Slovakia, Estonia, Latvia, Lithuania, Hungary, Slovenia: Air MKG will not be able to provide you with the delivery cost before the validation of your order. Air MKG therefore invites you to validate your order, which will constitute a reservation of your Product(s). Once this validation has been carried out, Air MKG undertakes to offer you a delivery price for your Product(s) within 48 hours. Upon receipt of this proposal, you will have a period of 48 hours to confirm your acceptance of these delivery costs by email. In case of acceptance, this will be equivalent to a firm and definitive validation of your order. Air MKG will then send you a summary email containing the various means of payment made available to you to pay for your order. In case of refusal of these costs, the reservation will be automatically cancelled and the Product(s) will be put back on sale on the Site.
7. Right of withdrawal
The provisions of this Clause are only applicable to Customers purchasing Products for personal needs (and therefore in no case when purchasing for professional needs).
7.1. Right and period of withdrawal
The Customer benefits, under the conditions provided for in Articles L. 221-18 to L. 221-28 of the Consumer Code, from a right of withdrawal relating to Products purchased on the Site, within a period of fourteen (14) calendar days from the day of receipt of the Products.
In the case of multiple orders (of several Products), the withdrawal period runs from the receipt of the last Product.
The Customer must express their decision to exercise their right of withdrawal before the expiry of the aforementioned period. The Customer has the possibility of completing and transmitting their declaration of withdrawal either:
• by contacting Air MKG Customer Service directly, who will tell you the procedure to follow
• The Customer may also send their request on plain paper to the following address: Air MKG – 1096 avenue André Lasquin 74700 Sallanches – France. The Customer may, if they wish, use the model withdrawal form available in Annex I of these Terms and Conditions.
The Customer will then receive confirmation of their withdrawal by e-mail without delay.
7.2. Free Product return procedure
As part of the exercise of the right of withdrawal, the Product must imperatively be returned in its original packaging, unopened, in perfect condition (not stained, damaged, worn or used), complete (including its user manual and accessories if applicable) so as to allow its marketing in new condition.
The return of a Product is free of charge, with the exception of the return costs of the product, which are the responsibility of the Customer (except for mainland France, where the return costs are covered by Air MKG). To do this, the Customer must send an email requesting a return label to Air MKG and return the Products to Air MKG via its carrier, within a maximum period of 14 days from the Customer's declaration of withdrawal, using the said return label.
If the Customer cannot or does not wish to use the pre-printed return label service, they can contact Customer Service who will register the Product return. In this case, Air MKG advises you to take out the insurance offered by your carrier. Air MKG will not be responsible in the event of loss, sending to the wrong address or delay in delivery of a Product that the Customer wishes to return to the Site, insofar as the risks of transport that the Customer has chosen and that the Customer initiates rests solely with the Customer.
Air MKG reserves the right to refuse the return of a Product and not to proceed with its refund:
• in the event of non-compliance with the withdrawal procedure mentioned above;
• generally if our Customer Service is not able to identify the Customer or identify the order (order number, return number, contact details, etc.),
• if the Product is not in its packaging and in its original condition (documents and accessories) in particular if the Product has suffered a depreciation due to its handling or use, in particular due to the risk linked to the fact that it is often products subject to the regulations applicable to personal protective equipment.
7.3. Refund
The refund of the returned Product(s) will be confirmed by email and will take place within a maximum period of fourteen (14) calendar days from the day Air MKG was informed of the Customer's decision to exercise their right of withdrawal. Air MKG however reserves the right to defer the refund until the date of actual receipt of the Product.
Air MKG will make the refund using the same payment method that you used for the initial transaction:
- If the payment was made by credit card, the refund will be made to the same credit card number;
- If the payment was made by bank transfer, the refund will be made by bank transfer after receipt of your bank details;
- If the payment was made by cheque, the refund will be made by cheque to the order you have indicated.
In the event that the Customer returns only some of the Products ordered and not all of them, the delivery costs will not be refunded to the Customer. Only the returned Product will then be refunded to the Customer.
Air MKG reserves the right to refund an express delivery at the standard delivery rate.
If the Customer does not use the return label provided with their order: it will be their responsibility to return the Products themselves and to keep any proof of return, which implies that the Products are returned by registered post or by any other means giving a definite date to this shipment. In this case, the return costs remain the responsibility of the Customer.
In the event of depreciation of a Product resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the Product, (in particular for Products returned incomplete, damaged, deteriorated, soiled or in any other condition that would reasonably suggest that they have been used, Air MKG reserves the right to refuse the refund or exchange of the damaged Product (unless it is a defective Product) which will be returned to the Customer.
Air MKG will not make any refund if the Products returned by the Customer do not correspond to the Product(s) ordered or if they have an origin other than the Site.
8. Product Guarantees
In general, all information relating to the use of the Products and in particular to the safety rules relating to these Products is contained in the user manual and the instructions for use delivered with the Product.
All Products benefit from the legal guarantee of conformity (articles L217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code) allowing the Customer to return defective or non-conforming Products delivered free of charge.
8.1. For Customers purchasing Products for personal needs
The Products sold by Air MKG are subject to the legal guarantee conditions provided for by articles L. 217-4 to L. 217-14 of the Consumer Code as well as by articles 1641 to 1648 of the Civil Code, to the exclusion of all other guarantees:
Article L. 217-4 Consumer Code:
The seller delivers goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. It shall also be liable for defects in conformity resulting from packaging, assembly instructions or installation where it has been made its responsibility by the contract or has been carried out under its responsibility.
Article L. 217-5 Consumer Code:
The goods are in conformity with the contract:
1° If it is fit for the purpose usually expected of similar goods and, where applicable:
- if it corresponds to the description given by the seller and possesses the qualities that the seller has presented to the buyer in the form of a sample or model;
- if it has the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer or its representative, in particular in advertising or labelling;
2° Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and that the latter has accepted.
Article L217-12 Consumer Code: The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.
When acting under the legal guarantee of conformity, the Customer:
- has a period of two years from the delivery of the Product to act against Air MKG;
- may choose between the repair or replacement of the Product, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code;
- is exempt from providing proof of the existence of the lack of conformity of the Product during the 2 years following the delivery of the Product
The legal guarantee of conformity applies independently of any commercial guarantee that may be granted. It is recalled that the Customer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and that in this case, he may choose between the resolution of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.
Within the framework of the legal guarantee of conformity, Air MKG undertakes, at the Customer's choice:
- either to repair the Product;
- or to replace the Product with an identical product depending on available stocks;
However, in accordance with Article L.217-9 of the Consumer Code, Air MKG may not proceed according to the Customer's choice if this choice has a manifestly disproportionate cost with regard to the other modality, taking into account the value of the good or the importance of the defect. Air MKG is then required to proceed, unless impossible, according to the modality not chosen by the Customer.
If the repair or replacement of the Product is impossible, the Customer may have the price paid returned and return the Product or keep the Product and have part of the price returned, unless the lack of conformity is minor. The return, replacement or refund of the Product will be free of charge for the Customer and does not preclude the possible allocation of damages in the event that the Customer is entitled to it.
8.2. For Customers purchasing Products for professional needs
Air MKG guarantees the Customer the replacement or refund of non-conforming Products for a period of twenty-four (24) months from their delivery. It does not guarantee any particular merchantable quality or any particular use not contemplated in the technical or commercial documentation of Air MKG. Any guarantee is excluded in the event of use of the product not in accordance with the user guides, the product sheet or the certificate of conformity emanating from Air MKG or when the deterioration of the product results from handling, inappropriate storage conditions, or a fortuitous event occurring after delivery. The anteriority of the fortuitous event to the delivery must be proven by the Customer.
The conformity of the products to the applicable legislation/regulation is understood exclusively from the place to which the products are delivered, Air MKG not guaranteeing their conformity to a legislation/regulation applicable to the place to which the Buyer intends them.
The refund or replacement does not in any case constitute an implicit recognition of liability by Air MKG.
8.3. For Customers purchasing Products for personal or professional needs
Article 1641 Civil Code:
« Le vendeur est tenu de la garantie à raison des défauts cachés de la chose vendue qui la rendent impropre à l'usage auquel on la destine, ou qui diminuent tellement cet usage, que l'acheteur ne l'aurait pas acquise, ou n'en aurait donné qu'un moindre prix, s'il les avait connus. »
Article 1648 alinéa 1er Code civil :
« L'action résultant des vices rédhibitoires doit être intentée par l'acquéreur dans un délai de deux ans à compter de la découverte du vice. »
Article 2232 du Code civil :
« Le report du point de départ, la suspension ou l'interruption de la prescription ne peut avoir pour effet de porter le délai de la prescription extinctive au-delà de vingt ans à compter du jour de la naissance du droit. »
En cas de vice caché :
-Il appartiendra au Client de prouver qu’il remplit bien les conditions de la garantie.
-Le Client aura le choix de rendre le Produit et se faire restituer le prix ou de garder le Produit et se faire restituer une partie du prix.
8.4. Exclusion de garantie
Sont exclus de ces garanties les défauts résultants :
- d’une utilisation des Produits non-conforme à leur destination,
- du non-respect des instructions d’installation, d’utilisation et conseils d’entretien des
- Produits
- de la détérioration et de l’usure normale des Produits,
- de la modification des Produits, ou d’un choc par torsion, compression, chute ou impact anormal du Produit.
8.4. Mise en œuvre des garanties
Au titre des garanties dont le Client bénéficie, Air MKG s’engage selon le choix du Client à :
- à rembourser intégralement le Produit
- réparer le Produit dans le cas où cela est possible et le renvoyer au Client à l’adresse indiquée par vos soins.
La procédure de retour des produits figure à l’article 7.2 des présentes CGV. Le Client devra par ailleurs préciser la non-conformité alléguée.
9. Service Clients
En cas de difficulté survenant à l'occasion de la commande, de la livraison des Produits, de la garantie des Produits ou afin de solliciter un règlement à l'amiable, le Client peut contacter le Service client :

10. Propriété intellectuelle
Tous les éléments reproduits sur le Site, en ce compris les textes, commentaires, photos, marques, logos, illustrations, photographies et images, ainsi que la technologie sous-jacente du Site et son architecture, sont protégés par des droits de propriété intellectuelle. Ces éléments sont et demeurent la propriété exclusive d’Air MKG ou du titulaire des droits de propriété intellectuelle concernés pour lesquels Air MKG a acquis régulièrement les droits d’exploitation.
Toute reproduction totale ou partielle du Site ou de l'un de ses éléments, par quelque procédé que ce soit, sur quelque support que ce soit, et pour quelque motif que ce soit, y compris tout lien hypertexte renvoyant vers le Site et utilisant notamment la technique du framing, du deep-linking, du in-line linking ou toute autre technique de lien profond est strictement interdite et constituerait une contrefaçon sanctionnée par les articles L.335-2 et suivants et/ou L.716-1 et suivants du Code de la propriété intellectuelle.
11. Protection des données personnelles
Sur le fondement de l’exécution du contrat de vente et de l’intérêt légitime de mettre en œuvre ses activités, Air MKG informe le Client que ses données personnelles sont collectées et traitées pour les besoins de la gestion de sa commande et plus généralement pour les besoins de la gestion de la relation client : création de compte, prise de commande, livraison, suivi de livraison, paiement, gestion et suivi droit de rétractation, demande d’échange ou retour, demande SAV.
Les informations concernant la façon dont nous traitons vos données personnelles sont détaillées dans notre Privacy Policy. Vous pouvez à tout moment accéder aux données vous concernant, vous opposer à leur utilisation, les rectifier ou les faire effacer. Vous disposez également d'un droit à la portabilité et d’un droit à la limitation du traitement de vos données. Si vous estimez, après nous avoir contacté, que vos droits « Informatique et Libertés » ne sont pas respectés, vous pouvez adresser une réclamation en ligne à la CNIL.
12. Limitation de responsabilité
La responsabilité d’Air MKG ne saurait être engagée pour tous les inconvénients ou dommages inhérents à l’utilisation du réseau Internet, notamment une rupture du service, une intrusion extérieure ou la présence de virus informatique, affectant l’accès ou le fonctionnement du Site, sauf en cas de négligence grave ou faute intentionnelle de notre part.
Si tous les efforts sont faits pour assurer que la couleur et le motif des Produits dont les photos sont affichées sur le Site soient fidèles aux Produits originaux, des variations peuvent intervenir, notamment en raison des limitations techniques de rendu des couleurs sur les équipements informatiques du Client. Par conséquent, Air MKG ne peut être tenu pour responsable d'erreurs ou d'inexactitudes non substantielles des photographies ou des représentations graphiques des Produits figurant sur le Site. En cas de questions sur les Produits, le Client peut naturellement prendre contact avec notre Service Client.
Le Site peut contenir des liens vers des sites tiers non édités ou non contrôlés. De tels liens sont uniquement fournis à titre de commodité ; ils ne peuvent et ne doivent pas être interprétés comme un aval exprès ou implicite de ces sites, de leur contenu ou de tout produit ou service qui y est offert.
13. Force majeure
La survenance d'un événement constitutif de force majeure au sens de la jurisprudence et de l’article 1218 du Code Civil entrainera la suspension des obligations pesant sur Air MKG. Cette inexécution du contrat ne pourra engager la responsabilité́ d’Air MKG. Si le cas de force majeure a une durée d'existence supérieure à un (1) mois, Air MKG pourra ne pas honorer la commande, à charge de rembourser le cas échéant le Client des sommes versées par lui au titre de la commande concernée.
14. Mode de preuve
Les Parties reconnaissent que l'écrit sous forme électronique est admis comme support probant au même titre que l'écrit sur support papier.
Pour les Clients achetant des Produits pour des besoins personnels : en application de l'article L213-1 du Code de la Consommation, lorsqu'une commande porte sur un montant égal ou supérieur à 120 Euros, Air MKG conserve l'écrit qui constate le contrat conclu entre Air MKG et un client par voie électronique pendant un délai courant à compter de la conclusion du contrat jusqu'à la date de livraison du bien et pendant une durée de dix ans à compter de celle-ci (en conformité avec le décret 2005-137 du 16 février 2005). Le Client dispose alors d'un accès à ce document à tout moment, sur demande effectuée auprès du Service Client via le formulaire de contact https://shop.airmkg.eu/fr/nous-contacter.
15. Droit applicable – Litiges
Le droit français est applicable aux présentes CGV.
Toutefois, si le Client ne réside pas en France Métropolitaine mais dans un autre pays de l’Union Européenne, celui-ci pourra se prévaloir des dispositions de loi applicables à son pays de résidence, lorsqu’elles sont plus favorables que les dispositions de droit français.
15.1. Pour les Clients achetant des Produits pour des besoins personnels
Le Client est informé qu’il peut en tout état de cause recourir à une médiation conventionnelle, ou auprès des instances de médiation sectorielles existantes, ou à tout autre mode alternatif de règlement des différends en cas de contestation.
Conformément à l’ordonnance n°2015-1033 et au décret n°2015-1382, tout différend ou litige dit de consommation, sous réserve de l’article L.612-2 du Code de la consommation, peut faire l’objet d’un règlement amiable de médiation auprès de CNPM MEDIATION CONSOMMATION (« CNPM ». Pour soumettre votre litige au Médiateur, vous pouvez (1) remplir le formulaire sur le site internet https://www.cnpm-mediation-consommation.eu/ onglet « saisir le médiateur », ou (2) envoyer votre demande par courrier simple ou recommandé au CNPM MEDIATION CONSOMMATION - 27, avenue de la Libération – 42400 Saint Chamond. Quel que soit le moyen utilisé pour saisir le CNPM, votre demande doit contenir les éléments suivants pour être traité avec rapidité : vos coordonnées postales, mail et téléphoniques, ainsi que le nom et adresse complet d’Air MKG un exposé succinct des faits et la preuve des démarches préalables effectuées auprès d’Air MKG.
A défaut de résolution amiable ou de recours à la médiation, les tribunaux français seront compétents pour connaitre de tous les litiges auxquels les présentes CGV pourraient donner lieu. Toutefois, dans les conditions visées à l’article 15 du Règlement n°44/2001, du 22 décembre 2000, le Client pourra saisir le Tribunal du lieu où il est domicilié (et sous réserve que ce domicile soit situé dans la Zone de livraison)
Depuis le 15 février 2016, la plateforme en ligne de règlement amiable des litiges de la Commission Européenne est ouverte au public. Tout consommateur qui rencontre un litige avec une entreprise située sur le territoire de l’Union a la possibilité de déposer une demande de médiation par le biais de cette plateforme européenne http://ec.europa.eu/consumers/odr. 15.2. Pour les Clients achetant des Produits pour des besoins professionnels
Tout litige relatif aux présentes Conditions Générales de Vente sera régi uniquement par le droit français Les parties renoncent expressément à l'application de la Convention des Nations Unies sur les contrats de vente internationale de marchandises et des Principes Unidroit. Le Tribunal de commerce de Grenoble est exclusivement compétent pour trancher tout litige.
ANNEXE 1 : MODELE DE FORMULAIRE DE RETRACTATION
Veuillez compléter et renvoyer le présent formulaire uniquement si vous souhaitez vous rétracter de la commande validée et payée. Ce formulaire doit être envoyé à Air MKG au plus tard quatorze (14) jours calendaires après la réception du ou des Produits.
